| The City of Richmond has until Tuesday, June 28, 2022, at 1:00 PM to deposit into escrow a deed to the Point Molate development areas in favor of Upstream and Guidiville or be held in contempt of Court. The pertinent documents are:
If the City of Richmond places the deed into escrow prior to 1:00 PM, June 28, 2022, presumably the Order to Show Cause hearing will be discharged. If not, the Minutes of the June 21 hearing state, “Any decision maker relative to completing transferring property into escrow shall appear for the hearing.” The Order to Show Cause states, “The City of Richmond, its counsel, and any decision maker who has information relative to completing the transfer of the property into escrow should personally appear for a hearing on this Order to Show Cause on Tuesday, June 28, 2022, at 1:00 PM, in the United States Courthouse, 1301 Clay Street, Oakland, CA, Courtroom 1.”
On June 21, the City Council appointed Gayle McLaughlin as the designated “decision maker” based on perhaps an erroneous interpretation that a single “decision maker” was ordered. Based on the actual Minutes, it would seem that the entire City Council was ordered to appear. In any event, I plan to be there. |
