Big Win for Point Molate Advocates

In a big win for those of us who have been advocating over 25 years for a well-designed mixed use project with 70 percent open space at Point Molate, Superior Court Judge Edward G. Weil provided a 42-page decision on January 31, 2022, denying the Petition for a Writ of Mandate challenging the CEQA review of the project. Click here for the decision.

This decision clears a major hurdle that has been haunting the Point Molate project for years. The petitioners on the losing end of this challenge include Point Molate Alliance, Ocean Awareness Project, Inc., Andres Soto, Sara L. Tobin, Anthony Sustak, Pamela Stello, Margaret Brown, David Helvarg, Citizens for Eastshore Parks, Golden Gate Audubon Society, California native Plant Society, Norma Wallace, Isabella Zizi, Sierra Club and SPRAWLDEF (collectively Point Molate Alliance or PMA), North Coast Rivers Alliance, pacific Coat Federation of Fisherman’s Associations, Institute for Fisheries Resources and San Francisco Crab Boat Owners Asociation (collectively North Coat Rivers Alliance, or NCRA).

The City previously prevailed in in a challenge to the City Council decision based on an alleged Brown Act violation, which is on appeal to the 9th Circuit.

So far, the City of Richmond has prevailed in all legal challenges to the Point Molate project following the 2018 settlement of the Federal Court lawsuit brought by Upstream Point Molate LLC and the Guidiville Tribe.
