  Chevron Continues to Erode City Damage Claims in 2012 Fire

Judge Barry Goode just granted two out of three of Chevron’s motions to eliminate claims against Chevron for the 2012 fire. He has ‘dismissed’ the City’s causes of action for lost property taxes and for damages related to an ‘ultrahazardous activity.’ In short, he ruled that Chevron has no duty to protect the City from loss of property tax revenue from Chevron’s own property due to a fire at the refinery. He also ruled that the refinery is not an ultrahazardous activity. Trial is scheduled to start as soon as next week.
