  Trial Court Victory for City in Point Molate Litigation - City Seeks Award of Attorney's Fees as Prevailing Party

The City has achieved a significant trial court victory over Upstream and the Tribe in the Point Molate LDA litigation: “The Plaintiffs shall take nothing from the City,” wrote federal district judge Yvonne Gonzalez-Rogers. Upstream and the Tribe had sued the City for over $750 Million and they “take nothing.”

The City has enjoyed a series of  victories in this case, culminating with entry of judgment against Upstream and the Tribe and in favor of the City on all claims against the City. Upstream and the Tribe have filed notice that they will appeal the judgment to the Ninth Circuit Court of Appeals.  The City has filed a motion seeking to recover its attorneys’ fees and costs.
